Illegal Collection Tactics
Debt collectors often exploit and pressure people illegally. You do have rights against unfair practices such as:
- Threatening to have you arrested for not paying your debt
- Telling other people, such as your neighbors or co-workers, about your debt
- Using obscene language with you
- Threatening your property or your reputation
- Failing to identify themselves
- Pretending to be a government official, lawyer or anyone other than themselves
- Charging or threatening to charge you additional fees or increased interest except what you originally agreed to pay
- Reporting false information on a credit report
Once you have hired an attorney, debt collectors cannot directly contact you. They have to talk to your lawyer instead. If you are facing harassment from a debt collector, contact us for a free initial consultation.
Laws that Protect You
If creditors, lenders or debt collectors do not follow these rules, you may be able to sue them for damages and attorneys' fees.
The Federal Odometer Act requires automobile dealers, of new and used vehicles, to provide you with the actual title to the motor vehicle to disclose mileage, as well as to disclose previous owners.
The Maryland Retail Installment Sales Act
The Fair Debt Collection Practices Act outlines actions that collectors cannot take such as threatening to have you thrown in jail. It also gives directions for things collectors must do, such as identify themselves and the original credit agency.
The Truth in Lending Act requires creditors and lenders to provide you with accurate information about charges and fees before you sign a contract.
The Consumer Leasing Act, like the truth in lending act, requires that you be given certain information, such as fees and charges, so that you can determine if one lease is
better than another.
